thinking about this yr's seriously terrible weather issues all over the world, war issues, presidency candidates attacking each other on very minor things, etc etc, I wonder a lot whatz the point of human life? Destroy the world? Shorten the life of our mother earth?
Only when reading this sort of creative designs, I will be aware of another function of human being: to make our lives more interesting and fun :)
 

最近很长一段时间以来对美国的法律产生了兴趣 :)　 学习过程中了解到了美国的平衡法里有一条很有趣的法律：equitable estoppel， 中文暂且翻译成：许诺不可自食其言。 英文的定义入下： In which a party is topped by his/her conduct from doing something he/she otherwise has a right to do. 这里的right means: right offered and protected by law. 经常看美剧的人想对一个场景应该很熟悉，在法庭上，辩方律师如果询问证人、被告一个问题，但是此人可以引用5th amendment来拒绝回答，就是不可自证其罪的宪法修正案。但是如果选择equitable estoppel后，就放弃了宪法、法律所赋予你的此项权利。 但是这个EQUITABLE ESTOPPEL有一个前提就是： clean hand doctrine，清白原则。 如果你申请使用本条法律，但是被证明你说谎，那么就会被驳回。 在美国合同法中有一个要求，就是consideration.这个的意思是，比如，我说我送你两百块，你问我what's the catch? 这个'catch'就是同consideration同样的意思，就是天下没有白吃的午餐，这个两百块我需要做什么？如果在立合同时，没有这个catch, consideration那么就不存在契约关系。 但是很多情况下，比如慈善等，会许诺捐款等，但是并不要求回报。或者，比如A是B的好朋友，A许诺B如果辞职那么可以到A的公司里有**的职位，但是当B辞职后，A并没有兑现他自己的许诺，致使B失业。此时就可以引用EQUITABLE ESTOPPEL 来起诉A。 因为A的食言，而是B造成了损失。 这个也是衡平法的原则， Equity. 但是我想，在实施过程当中，举证是一个很大的问题。
